BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned Carl Avenue located southwest from Hooker Road, northwest of Wilson Road, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Carl Avenue (as shown on tax map, but not as dedicated by plat of Allins Addition to Oak Hills, as shown by plat of record in plat book 2, page 47, ROHC), a 40 foot wide (per tax map) unopened right-of-way beginning on the southwest line of Hooker Road (formerly Hamill Road) some 910 feet northwest of the intersection of the southwest line of Hooker Road with the northwest line of Wilson Road, and extending southwest some 388 feet between parallel lines, and parallel to Wilson Road, to the northeast line of the Central of Georgia Railway right-of-way. Tax Map No. 167F-F-5 and 8. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 0C 1. The reservation for Jupiter Industries, Inc., d/b/a Chattanooga Gas Company, of an easement the width of the streets for its gas main, lines and other distribution facilities located within the petitioned rights-of-way, which must be maintained for the use and benefit of its customers. 2. Approval of the City Engineer and all public utilities. 3. The areas reserved for utility easements must be kept free and clear of all structures. 4. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
